Abstract

The research titled “A Childs Right to an Inclusive Approach to Parental Visitation in Separation, Divorce, and Relocation Disputes in a Digital Age in South Africa” examines how digital advancements can enhance parental visitation practices in South Africa. Chapter 1 introduces the study's objectives and significance within the digital context. Chapter 2 analyses South African laws on parental visitation, comparing them with international standards and identifying areas for improvement. Chapter 3 explores the practical application of visitation laws by South African courts, focusing on the benefits and challenges of virtual visitation. Chapter 4 draws lessons from international jurisdictions like Canada, the U.S., and Australia, and suggests how these can inform South African practices. Chapter 5 offers policy recommendations for improving visitation arrangements, advocating for legal reforms and ongoing research.
