These issues are discussed on the basis of problems in the South-African positive law and English law. In discussing the question about the nature of this labour-law relationship, a twostage approach is suggested, especially when bearing in mind that the employment contract forms the basis of the labour-law relationship between the two parties.Afrikaans© 2015.
