Abstract

The dissertations covers the aspects of international trade dispute resolution mechanisms available in South Africa. These covers the international trade dispute resolution mechanism available in WTO, and also covers those available in Africa. Africa as a new trading block, called AfCFTA, has also adopted the dispute resolution methods which are in line with the WTO methodology. The dissertation looks holistically at what is at disposal for the traders to use in resolving trade related disputes. The dissertation looks at other role players within the South African government in resolving these international trade disputes. The government policy is looked at and the available process is discussed. The dissertation also looks at whether there is a possibility to establish an independent international trade dispute resolution tribunal, which will specifically adjudicate all international trade related disputes across all government sphere, within the national borders of South Africa and how this trade tribunal will assist those who are involved in pursing access to justice.
