Abstract
The will of the people shall be the basis of the authority of government; this will shall be
expressed in periodic and genuine elections which shall be by universal and equal suffrage and
shall be held by equivalent free voting procedures1
The right to participate freely in the government of one’s country is recognized and protected
in many international human rights instruments. These include the African Charter on Human
and Peoples’ Rights (ACHPR), the International Covenant on Civil and Political Rights
(ICCPR), the European Convention for the Protection of Human Rights and Fundamental
Freedoms4 and the American Convention on Human Rights (ACHR). This right has generally
been understood to include among others things, the right to vote and be voted through an
election process that is free, fair transparent and convincing.
