| dc.description.abstract | Die skuldberadingsproses wat ingelei is deur die National Credit Act 34 van 2005 vervul belangrike rol om skuldverligting aan oorbelaste verbruikers te fasiliteer en om daartoe by te dra dat kredietverskaffers betalings ten aansien van kredietooreenkomste ontvang. In Firstrand Bank v Barnard 2015 JDR 1614 (GP) het die hof, in appèl teen landdroshofbevel vir skuldherstrukturering ooreenkomstig artikel 87 van die National Credit Act, verskeie pertinente aangeleenthede in die konteks van skuldberading aangeraak. Die doel van hierdie bespreking is om op aantal van hierdie aspekte te fokus, naamlik die magte van die skuldherstruktureringshof; likwidasie van bates; die omvang van openbaarmaking wat vereis word in skuldherstruktureringsaansoek; die impak van veranderde omstandighede op so aansoek, skuldberadersfooie en kostebevele teen skuldberaders. | en_ZA |
